1. RENTAL TERM & AUTO-RENEWAL

All rentals run in 28-day periods. Each period automatically renews until the customer calls or texts Summit Rentals to schedule pickup. Customer is responsible for the equipment until Summit Rentals confirms pickup.

2. EQUIPMENT USE RULES

Customer agrees to:

• Use equipment safely and legally.
• Keep equipment off public roads (unless towable).
• Not sublease, lend, or share equipment.
• Not use equipment for hazardous materials.
• Not overload or misuse equipment.
• Not relocate equipment without written approval.
• Ensure only trained, qualified operators use equipment.
• Not alter, modify, or tamper with equipment.

3. HOURS OF USE

• Generators: Limited to 8 hrs/day, 40 hrs/week, 160 hrs per rental period. Extra hours billed at standard overage rates.
• All other equipment: Unlimited hours.

4. INSURANCE OR RENTAL PROTECTION PLAN (RPP)

Customer must either: A) Provide valid insurance (GL + property coverage with Summit Rentals
listed as additional insured and loss payee), OR B) Purchase Summit Rentals’ Rental Protection
Plan (RPP).
RPP Deductible: Customer pays the first $1,000 of any covered loss. RPP does not cover: tires,
tracks, glass, misuse, negligence, overloading, unauthorized operation, or intentional damage.

5. DAMAGE & RESPONSIBILITY

Customer is responsible for:

• Full replacement cost for theft, loss, or destruction.
• All damage beyond normal wear.
• Always billable: tires, tracks, glass, mirrors, cosmetic damage, misuse, improper fuel/DEF, lack of lubrication, overloading, unauthorized operation.
• Cleaning charges for excessive dirt, concrete, or paint.
• Fuel charges if equipment is not returned full.

6. PAYMENT TERMS

Invoices are due upon receipt. Past-due balances accrue 1.5% interest per month (18% APR). Customer agrees to pay all collection costs, attorney fees, and administrative fees.

7. DEFAULT & REPOSSESSION

If payment is late or terms are violated, Summit Rentals may:

• Enter the jobsite or property without notice
• Repossess equipment immediately
• File mechanic’s liens or bond claims

Customer waives all claims for damages related to repossession.

8. LIABILITY

Customer assumes all risk of injury, death, or property damage arising from equipment use.
Summit Rentals is not liable for incidental or consequential damages.

9. RETURN OF EQUIPMENT

Equipment must be returned in the same condition it was received (normal wear excepted).
Customer remains responsible until Summit Rentals confirms pickup.

10. GOVERNING LAW

This agreement is governed by the laws of the State of New York.
